Easiway Terms and Policy

Payments:

Individual customers must pay at the time of booking a trip to secure advance reservations. Any charges are processed at the time of booking a trip and are refundable following the terms outlined in the cancellation policy below.

Your credit card will be removed after one week upon request. In case additional fee or penalty fee occurs, we will charge your credit card.

Easiway is owned and operated by by Easi6 Limited in at Hong Kong and Shenzhen.The following Policy describes how we operate, how we follow the local law, how we collect, use, disclose, and otherwise process personally identifiable information that we collect about individuals ("Personal Data") in connection with the services available from through the application available from Google play store, Apple app store and Several Chinese Android App markets. References to the App are deemed to include derivatives thereof, including but not necessarily limited to mobile applications. By using the application, you are consenting to the collection, use, disclosure and processing of your Personal Data as described in this Terms & Policy. In addition, by using the application and web of Easiway, you agree to become a member of Easiway reservation service. On behalf of members will, Easiway will purchase a transportation service with including drivers from rental car companies or other third party service provider. All data that we collect and process is stored on servers located in Hong Kong, a country that may not provide an equivalent level of data protection to the laws in your home jurisdiction.

On occasion Easiway may revise this Terms and Policy to reflect changes in the law, our Personal Data collection and use practices, the features of our App, or advances in technology. If we make revisions that change the way we collect or use your Personal Data, those changes will be posted in this Terms and Policy and the effective date will be noted at the beginning of this Terms and Policy. Therefore, you should review this Terms and Policy periodically so that you are up to date on our most current policies and practices. We will also prominently post such material changes prior to implementing the change.

Information We Collect:

We collect Personal Data about you that you provide to us while using the App and Web. Personal Data may include your name, phone number, credit card number or e-mail address. We also collect non-personally identifiable information, which may be linked to your Personal Data, including your log-in password, and search preferences related to specific location searches.

Protecting Your Personal Data

To prevent unauthorized access, we maintain reasonable physical, electronic and organizational procedures to protect Personal Data against accidental or unlawful destruction or accidental loss, alteration, or unauthorized disclosure or access. To protect credit card transactions, Easiway App currently uses Secure Socket Layer technology to encrypt credit card information during transit

How We Use the Information We Collect:

We use Personal Data and other information collected through the App to register you with the App and our Easiway Rewards program, to provide you with the requested products and services, to build features that will make the services available on the App easier to use, and to contact you about these services. This includes better customer support and timely notice of new services and special offers. From time to time, may contact you to request feedback on your experience using the App, to assist us in improving the App, or to offer special savings or promotions to you as a App user, where you have indicated your consent to receiving such communications. If you would prefer not to receive notices of special savings or promotions, you may simply opt-out from receiving them by submitting a message through 'Contact Us' option on the App.

Sharing Your Personal Data:

Easiway may share your Personal Data with third parties we employ to perform services on our behalf, to market our products and services, to handle credit card transactions and to otherwise provide you with customer service. All such third parties will be under an obligation to maintain the security and confidentiality of the Personal Data, and to process the Personal Data only in accordance with our instructions. In some cases, Easiway may require that you transact directly with a third party to obtain services, or when you use the App to reserve a van or obtain another product or service, we may provide your Personal Data to that van company or personal driver of van or other involved third party. Easiway may disclose Personal Data to protect ourselves against liability, to respond to subpoenas, judicial processes, legitimate requests by law enforcement officials, or as otherwise required in order to comply with applicable law, or to the purchasers in connection with any sale, assignment, or other transfer of all or a part of our business or company. We may also disclose Personal Data to enforce or apply the terms and conditions applicable to our products and services, or to protect the rights, property or safety of users, or others. In the situations described above, the recipient of the Personal Data may be located in a jurisdiction that may not provide an equivalent level of data protection to the laws in your home jurisdiction.

About Chauffeur Service:

Reservations of transportation from the user are valid only for the specified date and time. Easiway is not responsible for unused reservation or costs incurred as a result of customer error. When changing the pick up or drop off location of a reservation, rates are subject to change and additional charges may apply.

Short Notice Reservations/ Cancellation:

Short notice reservations are reservation change requests made less than 2 hours prior to requested pickup times for cross-border and within-Shenzhen-area trips and within-Hong Kong trips. We are unable to guarantee service availability or timely service for short notice reservations. Availability will depend on a variety of conditions, including pickup location, drop-off location, and current vehicle availability.

For cross-border, within-Shenzhen-area and within-Hong Kong trip reservations, full refund will be granted for cancelling up to 2 hours prior to requested pickup time. If user cancels in less than 2 hours before requested pickup time, no refund will be given.

Changes in Reservations:

Changes in reservation made less than 2 hours prior to requested pickup time for cross-border, within-Shenzhen-area and within-Hong Kong-area trips will not be accepted. Easiway does not accept a request of pickup earlier than selected pickup time made by leaving a note in the app, phone call, and social media channels. Currently, Easiway app and web does not support changing in reservations. To make changes in reservation, user must cancel and book again via the app only.

Reservation Abandonment:

For trips that cross the border and those that don’t, reservation abandonment occurs when the Driver/Operator cannot find the customer at the designated pickup location, date and time and cannot reach the customer for further instructions using the reservation contact information from “Easiway driver application. This is to not jeopardize pickup of other passengers. A trip will be considered a no-show if users are out of reach and do not show up within one hour at a designated location and time. There will be no refund for such abandonment of reservation.

Rates:

Tolls, taxes and other fees may be not included in the calculated cost of the ride and customer may be responsible for additional charges. Reservations for transportation with multiple stops will be routed from furthest pick-up point to the closest, and quoted accordingly. You can find a price information table at geteasiway.com

For cross-border trips, driver will wait free of charge for up to 30 minutes after pickup time. Between 30 minutes and one hour after pickup time, an additional charge of 200RMB will occur. Waiting fee of 200 RMB per hour will separately occur after one hour has passed from pickup time. For example, if driver has waited for one hour and half, the extra fee will be 400RMB.

For within border trips, driver will wait free of charge for up to 30 minutes after pickup time. Between 30 minutes and one hour after pickup time, an additional charge of 200HKD/ 200RMB will occur. Waiting fee of 200 RMB/ 200HKD per hour will separately occur after one hour has passed from pickup time. For example, if driver has waited for one hour and half, the fee will be 400HKD/ 400RMB.

For cross border trips, extra stops in Hong Kong and Shenzhen will account for 200RMB. For within border trips, each stop in Hong Kong or Shenzhen will be 100HKD/ 100RMB.

Payments:

For reservations booked curbside, payment options vary and are dependent on location.

(Personal Identification)

Our operators and staff reserve the right to request personal identification from customers with fares exceeding 2,300HKD/ 2,000RMB. Failure to provide personal identification matching information on file may result in the inability of the company to service the reservation.

(Direct Bill-Invoice)

Direct Bill accounts allow customers to book online, by phone, or in-vehicle. Accounts are billed after the reservation is complete. These accounts are typically managed as part of Corporate Accounts and require credit approval.

(Discounts)

Discount codes are valid for use while reserving the service via the official mobile applications. They cannot be combined with other offers. They cannot be redeemed using third party providers. Discounts cannot be applied during phone reservations. Under no circumstances will a discount be applied past the expiration date.

(Receipts)

Phone- and web-based reservations have the option to receive an email confirmation(e-invoice) with complete reservation and payment details.

Driver Representations and Warranties:

By providing Services as a Private Driver/Van company Driver("Driver") on the Easiway Platform, you represent, warrant, and agree that:

Our Policy Concerning Crossing Border:

"Baggage" or "baggage" means your personal property accompanying you in connection with your trip. Unless otherwise specified, it includes all of your unchecked Baggage. Easiway and the Van driver does not have any liability on object inside of your baggage which is legally not allowed to carry in China and Hong Kong. By using the App and Web of Easiway, you are consenting that there could be a random base of baggage checking by the custom officers. By using the App and Web of Easiway, you are consenting that the unlimited liability of your personal belongings are on you.

When Easiway users cross the border between Hong Kong and Shenzhen, customs and immigration checks will take place in the vehicle. Easiway bans carrying of all illegal items, including electronics and luxury products, in inside its vendor’s vehicle by users. Easiway can reject all users who carry undeclared items and other objects that may raise a flag during custom checks on its vendor’s vehicle. No refund will be granted to such users. Users with two or more undeclared items that are each worth more than 5,000RMB will be rejected.

Users are fully responsible for their belongings. Users with legally problematic items may be rejected by Easiway and will be charged with an additional 300RMB. Item that may not be illegal, but may raise a red flag during customs will be charged with an additional 300RMB. If user hits a problem during customs without prior notice to Easiway, user will be fully responsible and will be charged with extra fee worth equal amount of user’s fare for the reservation. Users who have faced custom problems while using Easiway may have his or her account permanently closed.

If users want to use Easiway to move large amount of luggage across the border, she or he must give prior notice to the company. An extra charge of 300RMB will occur. If user refuses to make the payment, Easiway has the right to reject the reservation. For users who are attending the conventions at Hong Kong or Shenzhen’s convention centers, an additional fee of 300RMB will occur if he or she is carrying items used for exhibition such as posters and samples worth under 5,000RMB.

LIMITATION OF LIABILITY.

EASIWAY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF EASIWAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EASIWAY SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY THIRD PARTY PROVIDER, EVEN IF EASIWAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EASIWAY SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND EASIWAY'S REASONABLE CONTROL. YOU ACKNOWLEDGE THAT THIRD PARTY TRANSPORTATION PROVIDERS PROVIDING TRANSPORTATION SERVICES REQUESTED THROUGH SOME REQUEST BRANDS MAY OFFER RIDE SERVICES AND MAY NOT BE PROFESSIONALLY LICENSED OR PERMITTED OR TRAINED. IN NO EVENT SHALL EASIWAY'S TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED 3,450HKD/ 3,000RMB. EASIWAY'S SERVICES MAY BE USED BY YOU TO REQUEST AND SCHEDULE TRANSPORTATION, GOODS, OR LOGISTICS SERVICES WITH THIRD PARTY PROVIDERS, BUT YOU AGREE THAT EASIWAY HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY TRANSPORTATION, GOODS OR LOGISTICS SERVICES PROVIDED TO YOU BY THIRD PARTY PROVIDERS OTHER THAN AS EXPRESSLY SET FORTH IN THESE TERMS.

How You Can Access or Change Your Personally-Identifying Information:

If you wish to update any Personal Data you have previously provided, or to exercise any right of access, rectification, deletion, or opposition to the processing of your Personal Data that you may have under applicable law, please email us at support@easi-way.com. To protect your privacy and security, we will verify your identity before granting access or making changes to your Personal Data. Any request to access your Personal Data will be answered in less than 30 days.

Cancel Policy Information:

We understand your travel plans may change, so we offer a simple cancellation policy. For cross-border, within-Shenzhen-area and within-Hong Kong travel, give us 2 hours’ notice prior to your pickup time, and we will give you a full refund. If user cancels in less than 2 hours, no refund will be given. Refunds normally show on your account within three to five business days. Credit card refunds are submitted to the financial institution within one business day; check with your financial institution for more information. Easiway is unable to refund payment if canceled in less than than 2 hours’ notice for cross-border, within-Shenzhen-area and within-Hong Kong-area trips prior to pickup time or in the event of a no-show.

When you need to go to airport, failure to contact Easiway with flight cancellation or delay information in a timely manner may be considered reservation abandonment and may result in forfeiture of fare.

User Error:

Customer is responsible for providing accurate information at time of booking a trip. When he/she provides information for travel, the customer agrees that the information will be accurate. Easiway is not responsible for mistakes made by customers while using the service, its official websites, or mobile applications.

Confirmation emails are provided at the time of booking to allow customers to review details of their reservation in advance of the reservation. Additionally, certain locations provide automated reminder phone calls the day before pickup, allowing the customer time to cancel or make any changes two hours or more in advance of the reservation, as required by the Cancellation Policy outlined above.

Travel Times and Delays:

Easiway and its partners are not responsible for significant delays in anticipated arrival due to traffic, weather, or road conditions, or any other unforeseen circumstances. Customer should consider a travel time to ride for catching a plane, ship or other forms of scheduled transportation when makes reservation. Under such conditions, Easiway reserves the right to cancel and refund reservations in advance of the scheduled pickup.

Child Seats Policy:

While laws vary from Hong Kong to China, we support the strongest safety standard by recommending that small children five years and under be secured in a child restraint seat for transportation. If local law requires your child be secured in a child safety seat, please bring one as it is the parent’s or caregiver’s responsibility. We do not provide child restraint seats and likely will not be able to provide service without one.

Shuttle Tickets:

It is hereby stated that Easiway is not engaged in providing any services by itself but is a platform, which merely connects the business to customers. It does not own the product/services. By agreeing to this terms and policy, you are agreeing to the terms and policy set by the transport operators.

You agree that any liability in relation to the product being sold/services being offered on Easiway shall be that of the transport operators and not the Easiway. In case of any deficiency of products/services, you agree to pursue any such action arising from such deficiency of products/services against the transport operators and not the Easiway.

Easiway will process the ticket cancellation and change request from customers as per the policy of the transport operator. The cancellation fee and the period will differ for each transport operator. Please refer to the bus operator's change and cancellation policy. Other Policies:

1. Passengers are required to obtain valid travel documents and valid Visa to cross the border or travel within Hong Kong or China.

2. No explosive, inflammable, corrosive, military weapon or any unauthorized goods onboard. Easiway will not be responsible for all custom issues of passenger's luggage.

3. No smoking in the Easiway vehicles.

4. Due to the weather conditions and traffic congestions, there may a delay in your pick up or drop off. Easiway will not be responsible for any monetary loss. If you need to catch a flight or train, we strongly advise you to book two (2) to five (5) hours ahead of boarding time.

Language:

Translations of this Privacy Policy are available in other languages for your convenience. In case of conflict between the English language version and a translated version, the English language version shall prevail.
